As the changes from 2025 settle in and become the norm and we move further into 2026, one thing has become abundantly clear: the rules governing how real estate professionals interact with buyers have permanently changed. Firms that fail to adapt will risk more than lost commissions: they risk regulatory scrutiny, litigation exposure and reputational damage.
The requirement that buyer agents execute written representation agreements before touring property is no longer simply a “best practice”, it is now a cornerstone of brokerage compliance and consumer transparency. Yet across New York State we continue to see confusion, inconsistent office policies and missed educational opportunities simply because many agents are having difficulty differentiating between a customer and a client.
In addition, some agents view the new landscape as an opportunity to double dip by attempting to collect commissions on both the seller and buyer side…a sure fire recipe for disaster.
This year, it is essential for every brokerage firm to refocus on this issue and ensure their agents fully understand both the legal obligations and the practical business implications moving forward.
